ACCEPTABLE USE POLICY

Please read this Acceptable Use Policy (the "Policy") for LSM Hosting Services carefully before opening an account with LSM or continuing to use LSM Hosting Services. The intent of this policy is to provide a clear understanding of LSM's expectations for customers. Under the terms and condition of the Agreement for Website Development and Hosting Services between Customer and LSM, and by using LSM Hosting Services, Customer agrees to be bound by this Policy.

1. General . Customer is responsible for the activities of employees, agents and independent contractors and, by accepting service from LSM, is agreeing to full responsibility for the actions thereof in relation to any Customer website hosted by LSM. Complaints about Customers will be forwarded to the LSM Customer Service Department for action. If activity in violation of this Policy continues, Customer's products and services may be subject to termination or other action as LSM deems appropriate without notice. LSM reserves the right to modify this Policy at any time, effective upon posting to this site. LSM has no practical ability to monitor all conduct, communications, or content which might violate this policy prior to its transmission on LSM's network. Therefore LSM does not assume liability to Customers for violation of the Policy by any other LSM Customer.

2. Customer Responsibility . Customer shall ensure that its employees, agents and independent contractors comply with the terms and conditions of this Policy. Any access to other networks connected to LSM's network must comply with the rules of the other networks, newsgroups, and Usenets. Customer shall not use or permit its employees, agents and / or independent contractors to use the Services in ways that violate laws, infringe the rights of others, interfere with Subscribers of LSM's network or other networks, or otherwise violate the Policy. For example, and without limiting the scope of the foregoing, Customer and Subscribers shall not utilize LSM's network to engage, attempt, or otherwise assist in (a) the distribution of chain letters or UBE (unsolicited bulk electronic mail); (b) the propagation of computer worms or viruses; (c) the impersonation of another person with fraudulent or malicious intent; (d) the compromising of the security, or the unauthorized access of any site or network; (e) the distribution of child pornography, obscenity or defamatory material over the Internet; (f) the infringement of copyrights, trademarks or other intellectual property rights; (g) the interception of electronic transmissions; (h) the perpetuating of a fraud; (i) the contacting of another person so as to annoy, abuse, threaten, or harass such other person; (j) Ponzi schemes, chain letters, pyramid schemes or other such scams; (k) the forging of any email message or header, in whole or in part; (l) e-mail or news bombing; (m) the use of IRC bots; (n) the sending of email defined as “spam” by any State or Federal statute, rule or regulation; or (o) any other activity or purpose in violation of law, or in such a manner as to interfere with the use of the LSM services by other LSM customers. Customer further agrees to comply with U.S. export laws concerning the transmission of technical data and other regulated materials via the Services.

3. Inactivity Disconnect Policy . Idle connections are not permitted. LSM reserves the right to disconnect a connection to any websites which it hosts after 15 minutes of inactivity, as detected by LSM through electronic means. This time is approximate and subject to reasonable change without notice in LSM's sole discretion. Electronic or mechanical means to avoid an inactivity disconnect are strictly prohibited. LSM reserves the right to electronically audit connections to enforce the above requirements.

4. Privacy Protections . LSM hereby informs subscribers that the Privacy Policy for any particular site hosted by LSM may be found on that site.

5. Reporting and Enforcement . If you are aware of a potential violation of this Policy, please direct the information to abuse@leadstreams.com. The LSM Customer Service Department will investigate potential violations before taking action. All complaints will be investigated, and enforcement action will be taken as appropriate.
